ALLGEMEINE BESTIMMUNGEN

1. Die Webseite http://www.fajerwerkibiegun.com ist ein Onlineshop von:

Biegun Pirotechnika

2. Die Allgemeinen Geschäftsbedingungen (nachfolgend AGB genannt) bestimmen die Grundsätze zu Bestellung und Verkauf von Waren im Onlineshop www.fajerwerkibiegun.com.

3. Durch Tätigung einer Bestellung erklären Sie sich mit unseren AGB einverstanden.  

4. Gemäß den geltenden Vorschriften dürfen die pyrotechnischen Artikeln ausschließlich an volljährige Personen verkauft werden.

Da es ist nicht möglich ist, das Alter des Kunden beim Internet-Kauf zu prüfen, erklärt sich der Kunde einverstanden, sein Alter durch die Zustellungsfirma bei der Lieferung prüfen zu lassen.  

5. Der Kaufvertrag wird gemäß dem polnischen Recht geschlossen.  

TÄTIGUNG UND AUSFÜHRUNG DER BESTELLUNGEN

1. Für die Tätigung einer Bestellung ist das Anlegen eines Benutzerskontos nicht erforderlich. Die Bestellungen werden durch das Versenden des auf der Webseite www.fajerwerkibiegun.com beigelegten Bestellformulars angenommen. 

2. Für die Durchführung vdes Verkaufs ist es notwendig, im Formular erforderliche und richtige personenbezogene Daten des Kunden anzugeben, insbesondere: 

- richtige und korrekte Wohnanschrift,

- richtige und korrekte Telefonnummer,

- korrekte und gültige E-Mail Adresse für die Korrespondenz 

Der Shop haftet nicht für die Folgen der durch den Kunden angegebenen unkorrekten Daten.  

3. Der Shop behält sich vor, die getätigte Bestellung zu prüfen und zu stornieren, wenn es Zweifel zu ihrer Wahrhaftigkeit gibt. 

4. Der Kunde wird per E-Mail benachrichtigt, dass er eine Bestellung via Onlineshop getätigt hat. Sämtliche Informationen über den Status der Bestellung, Ausführungstermine, Sendung-Nummer und Kontaktangaben zur Lieferfirma werden an die angegebene E-Mail des Kunden versendet. 

5. Die Bestellungen via Onlineshop können 24 Stunden pro Tag, 7 Tage die Woche das ganze Jahr über getätigt werden. 

6. Die Ausführungszeit wird ab dem Eingang der Zahlung gerechnet und hängt von ausgewählten Produkten ab. Die Lieferungszeit zählt nicht zu der Ausführungszeit der Bestellung. 

Die Ausführungszeit der Bestellungen:

In Monaten November und Dezember kann die Lieferungszeit bis zu 14 Tagen dauern. 

ZAHLUNGEN

1. Die via Onlineshop www.fajerwerkibiegun.com kaufenden Kunden erklären sich damit einverstanden, dass die Verkaufsunterlagen ohne ihre Unterschrift ausgestellt werden. 

2. Für jede Bestellung wird standartmäßig ein Kassenzettel ausgestellt, der als Kaufnachweis gilt. Auf Wunsch wird auch eine Rechnung mit berechneter Umsatzsteuer ausgestellt. Dies soll bei der Bestellung gemeldet werden.

3. Der Kunde hat folgende Zahlungsmethoden zur Wahl: 

- Kreditkarte - der Betrag wird durch PayPal erhoben;

- direkte Banküberweisung an die auf der Web-Seite angegebene Kontonummer; 

- Western Union - der Kunde hat folgende Angaben anzugeben: Vor- und Nachname des Absenders, Betrag und die in WU erhaltenen Kode-Nummer;

- direkte Überweisung an das auf der Web-Seite angegebene Konto von Paysafecard;

- direkte Überweisung an das auf der Web-Seite angegebene Konto von Ukash.

REKLAMATIONEN UND RUCKSENDUNG DER GEKAUFTEN WAREN

1. Rückgabe der Waren. Anonyme Lizenzen. Gemäß dem „Gesetz vom 02.03.2000 (das polnische Recht) über Verbraucherschutz und Haftung für Schäden, die durch Gefahrgut verursacht wurden“, hat der Kunde das Recht zur Rückgabe der Waren innerhalb von 14 Tagen ab Abnahme der Sendung, ohne die Gründe nennen zu müssen, unter der Bedingung, dass die rückgegebenen Waren nicht beschädigt sind und nicht gebraucht wurden. Die Rückgaben sollen an folgende Anschrift gerichtet werden:

2. Der Kunde trägt die Kosten der Warenrückgabe. Der Shop erstattet nur den Preis der Waren. Der Shop nimmt keine Sendungen per Nachnahme an.

3. Reklamationen. Wenn die gelieferte Ware Mangel aufweist, hat der Kunde das Recht auf Nachbesserung oder Nachlieferung. Der Kunde soll uns per E-Mail über einen solchen Fall benachrichtigen.

4. Die Reklamation wird maximal bis zu 14 Tagen ab Meldungsdatum bearbeitet. Der Kunde wird über die Ergebnisse in Form einer elektronischen Mitteilung informiert, die auf die im Bestellformular vom Kunden angegebene E-Mail versendet wird.

DATENSHUTZ

1. Die personenbezogenen Daten unserer Kunden werden ausschließlich für den Bedarf des Onlineshops gesammelt und ausschließlich zur Ausführung der Gewerbe-, Angebots-, und Werbetätigkeiten verarbeitet, wobei die Anforderungen des Datenschutzgesetzes vom 29. August 1997 (Gesetzblatt Dz. U. 1997 Nr. 133 Pos. 833) erfüllt werden.

We guarantee the fulfillment of all your rights under the general Data Protection Regulation, i.e. the right to access, rectify and delete your data, limit their processing, the right to transfer them, not be subject to automated decision making, including profiling, and the right to object to the processing Your personal data.

    - regarding the request for data rectification: you will notice that your data is incorrect or incomplete;

You have the right to object to the processing of your personal data when:

    -the processing of your personal data is based on a legitimate interest or for statistical purposes, and the opposition is justified by the particular situation in which you have found yourself,

Who do we share your personal information with?

We provide your personal data to parties of transactions that you include at Biegun Pirotechnika and entities supporting us in the provision of electronic services, namely those that provide payment, credit, insurance, courier services, perform consulting or auditing services, support Biegun Pirotechnika  users, support the promotion of offers, they cooperate as part of marketing campaigns. We may pass on your personal data to public authorities fighting against fraud and abuse.

How long do we keep your personal data?

We store your personal data for the duration of the contract concluded with you, as well as after its completion for the purposes of:

 -pursuing claims in connection with the performance of the contract,

- performance of obligations resulting from legal regulations, including in particular tax and accounting,

- preventing abuse and fraud,

- statistical and archiving,

- for a maximum of 10 years from the date of completion of the contract.

We store your personal data for marketing purposes for the duration of the contract or until you object to such processing, whichever occurs first.

In the case of the organization of loyalty programs, competitions and promotional campaigns in which you can take part - we will process your data for the duration and the period of settlement of awards. In order to ensure accountability, ie to prove compliance with the provisions on the processing of personal data, we will store data for the period in which Biegun Pirotechnika is obliged to maintain data or documents containing them to document the fulfillment of legal requirements and enable control of their compliance by public authorities.

Do we pass your data to countries outside the European Economic Area?

Your personal data will be transferred outside the European Economic Area to Google LLC based on appropriate legal safeguards, which are standard clauses of personal data protection, approved by the European Commission.

Do we process your personal data automatically (including through profiling) in a way that affects your rights?

Your personal data will be processed in an automated way (including in the form of profiling), however, it will not cause any legal effects to you or substantially affect your situation.

Profiling of personal data by Biegun Pirotechnika involves the processing of your data (also in an automated way), by using them to evaluate certain information about you, in particular to analyze or forecast your personal preferences and interests.

PRODUCTS LEGALITY

All our pyrotechnic products has 1.4G&1.3G explosive class (no need to have permission). Trade of these products is allowed on all European Union territory and in all other countries that accept European Union requirements.
